Which claims can use federal IDR?

Federal IDR determines payment amounts for certain out-of-network items and services. Eligibility depends on the service, coverage, and applicable jurisdiction; an underpayment alone does not establish eligibility.

Does IDR overturn a medical-necessity or coverage denial?

A denial of payment is not the same as a denial of coverage. Medical-necessity and other adverse benefit determinations may require an internal appeal or external review. Establish coverage and federal IDR eligibility before treating a claim as a payment dispute.

What should a practice prepare?

Gather the EOB, claim identifiers, service dates and locations, service and place-of-service codes, the other party’s contact details, and the required eligibility attestation. Preserve the negotiation record and supporting offer evidence.

Does federal IDR or state law apply?

The answer depends on the plan, service, and applicable state law or All-Payer Model Agreement. Use the CMS applicability chart and relevant plan information; location alone is not a complete jurisdiction test.

What fees should a practice budget for?

Distinguish the federal administrative fee from the certified IDR entity’s fee. The May 2026 operations final rule announces a $15 administrative fee per party per dispute. Check applicability dates and the selected entity’s fee schedule before filing; a historic fee quoted in an article may not apply to a new dispute.

When can a party initiate federal IDR?

CMS describes a 30-business-day open negotiation period followed by a four-business-day initiation window, subject to extensions. Check current notices and transition guidance before calculating a case deadline.
